Protecting your private information is our priority.  This Statement of Privacy applies to both Cramer Imaging (Company) as well as “cramerimaging.com” (Company website) and governs data collection and usage.  For the purposes of this Privacy Policy, unless otherwise noted, all references to Cramer Imaging include cramerimaging.com, company, subsidiary name and webpage.  The Company website is a photography site.  By using the Company website, you consent to the data practices described in this statement.

The headings used in this policy are included for convenience only and will not limit or otherwise affect this policy.

Collection of Your Personal Information: What Personal Data We Collect and Why We Collect It

We do not automatically collect personally identifiable information from our users.  We may gather personal or non-personal information in the future.

Information about your computer hardware and software may be automatically collected by Company.  This information can include: your IP address, browser type, internet service provider, and access times.  This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Company website.

Company collects general non-personal information about you, such as your website activity, mouse and swipe actions, visit durations, and referring website addresses, for purposes of creating a user profile and creating more content which you like.

Personal information collected by Company, or its third party partners, may include, but not limited to, name, email addresses, mailing and residential addresses, phone numbers, and products purchased.  Mailing addresses are only collected for the purpose of delivering your order to you.  Phone numbers are collected for the sole purpose of communicating with you about your order.  Email addresses may be used in communicating with you about your order and may also be used in further Company communications such as email newsletters.

Company only shares personal information with trusted third party partners who have our level of security or higher for the purposes of performing functions such as newsletter emails and credit card processing.

Company does not receive your credit card information so we do not store this information.

Company encourages you to review the privacy statements of websites you choose to link to from Company website so that you can understand how those websites collect, use, and share your information.  Company is not responsible for the privacy statements, data collection and management, or any other content on third-party websites.

How Long We Retain Your Data

Company keeps information, personal and non-personal, on file indefinitely or until our third party services deem that they no longer need the information.  These third parties could deem this duration a matter of days or longer.

If you leave a comment, the comment and its metadata are retained indefinitely.  This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile.  All users can see, edit, or delete their personal information at any time (except they cannot change their username).  Website administrators can also see and edit that information.

Company does not receive your credit card information so we do not store this information.

Learning What We Collect About You and Your Rights

If you have an account on this site, or have left comments, you can request to receive an exported file of the personally identifiable data we hold about you, including any data you have provided to us.  You can also request that we erase any personally identifiable data we hold about you.  This does not include any data we are obliged to keep for administrative, legal, or security purposes.

If you want to learn what personally identifiable information we collect about you specifically, then use the contact information below and send us a request.  This request is not for information about you in general.

Displaying Personal Information

It is the Company’s policy to not display names of private individuals, other first name and last initial, in association with any images the Company posts.

It is your responsibility to inform the Company if you wish wish to alter the above specifications in any way, shape or form including, but not limited to full name associations, no name associations, initials, and additional name associations. Instructions must be presented in writing and signed by the you, your parent or guardian if underage, and the individual whose name appears as signatory to the contract, if different from the previous.

While using some of the Company’s website features, such as Facebook commenting, you will be making some of your personal information (including your name and current profile photo) visible to the public. If you do not wish to display this information, your choice is to not use the service.

Public Commenting Policy

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it.  The Gravatar service privacy policy is available here.  After approval of your comment, your profile picture is visible to the public in the context of your comment.

All comments are moderated before they are made public.  Any comment made which, in our sole discretion, violates our Terms of Service will be deleted immediately without publication.

Be polite and purposeful with your public commenting.

We reserve the right to delete any and all comments as necessary, at any time, without notice.

Contact Forms

Company provides contact forms for the purpose of receiving questions and other feedback from customers and other users.  These contact forms are provided as a service and are optional.  Company does collect personally identifiable information through these forms.  This personally identifiable information includes your name and email address.

By using Company’s contact form, you may be providing your personal information to Jotform or WordPress’ Contact Form 7 and associated plugins.  Company may, at our sole discretion, add your name and email to our company newsletter (which can include marketing).  Your use of Company contact forms signifies your acceptance of and agreement to being added to Company newsletter.  Should you change your mind, you may opt out of Company communications using the information below.

Use of Cookies

The Company website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize Company pages or register with Company site or services, a cookie helps Company to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Company website, the information you previously provided can be retrieved, so you can easily use the Company features that you customized.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Company services or websites you visit.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Security of Your Personal Information

To secure your personal information from unauthorized access, use or disclosure, Company uses the following:

Secure Socket Layer (SSL)

“SSL (Secure Sockets Layer) is the standard security technology for establishing an encrypted link between a web server and a browser. This link ensures that all data passed between the web server and browsers remain private and integral. SSL is an industry standard and is used by millions of websites in the protection of their online transactions with their customers. When a browser connects to a secure site it will retrieve the site’s SSL Certificate and check that it has not expired, it has been issued by a Certification Authority the browser trusts, and that it is being used by the website for which it has been issued. If it fails on any one of these checks the browser will display a warning to the end user letting them know that the site is not secured by SSL.”

We also use a content security policy to prevent unauthorized access from outside malicious code.

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included.  Visitors to the website can download and extract any location data from images on the website.

Company does not receive your credit card information so does not store that information.

What Data Breach Procedures We Have in Place

As soon as we are alerted to a possible data breach either on our services or on one or more of our third party services, we will make every effort to communicate with you about the breach. We may use your email address, phone number, mailing address, etc. based on what we have on file at the time and, preferably, in that order.

We will include any instructions given to us regarding the breach for you to follow and secure your information.

We follow any and all instructions given to us within the best of our ability on our end to secure your data from a breach.

Children Under Thirteen

Company does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.

Opt-Out & Unsubscribe

We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information.  Users may opt-out of receiving any or all communications from Company by contacting us using the contact information below.

Alternatively, you can also unsubscribe from all email communications using the unsubscribe link in the footer of every company newsletter.

Third Parties We Share Your Data With

Visitor comments may be checked through an automated spam detection service.

Articles on this site may include embedded content (e.g. videos, images, articles, etc.).  Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

The following is a list of the third party companies which Company uses for information gathering.  They may or may not have information about you depending upon how you have used our service in the past.

Industry Regulatory Disclosure Requirements

In the United States, there are a set of rules or laws which generally govern photography. While laws may vary between jurisdictions, the general idea is the same. Do make a point of checking your local jurisdictional laws before taking anything listed here as law.

Public Property

It is legal to photograph or videotape anything and anyone on any public property, within reasonable community standards. Photographing or videotaping a tourist attraction, whether publicly or privately owned, is generally considered legal, unless explicitly prohibited by a specific law or statute.

Private Property

Photography may be prohibited or restricted by a property owner on their property.  However, a property owner generally cannot restrict the photographing of the property by individuals who are not within the bounds of the property. Photography on private property that is generally open to the public (e.g., a shopping mall) is usually permitted unless explicitly prohibited by posted signs.  Even if no such signs are posted, the property owner or agent can ask a person to stop photographing, and if the person refuses to do so, the owner or agent can ask the person to leave; in some jurisdictions, a person who refuses to leave can be arrested for criminal trespass, and many jurisdictions recognize the common-law right to use reasonable force to remove a trespasser; a person who forcibly resists a lawful removal may be liable for battery, assault, or both.

Privacy Issues

Photographing private property from within the public domain is not illegal, with the exception of an area that is generally regarded as private, such as a bedroom, bathroom, or hotel room.  In some states there is no definition of “private,” in which case, there is a general expectation of privacy.  Should the subjects not attempt to conceal their private affairs, their actions immediately become public to a photographer using normal photographic equipment.

Changes to This Statement

Company will periodically update this Statement of Privacy to reflect Company and customer feedback along with continuing to be in compliance with changes/updates to local, state, federal, and international laws.

Company encourages you to periodically review this Statement to be informed of how Company is protecting your information. Company may choose to inform customers with accounts on this site of changes and updates to this privacy policy via email. Ultimately, it is your responsibility as a user and customer to keep track of updates to this policy.
